  2. This is "real". But it's "real" in the same sense that the ACE 3DS Pro "flashcard" was "real". I put the words real and flashcard in quotes because what this actually is is apparently a 1:1 clone of a 3DS cartridge. There's a longer video without the cuts on that youtube channel.

What is expected of this cart is that it will be able to play commercial 3DS roms, but apparently not any unsigned code (meaning no homebrew such as emulators and indie games). If you google the Ace 3DS Pro then that's apparently a similar approach to this. Although the Gateway card allows you to swap out different roms using a MicroSD card, instead of ACE's permanent and non-changeable game built into the card itself.

So it is not so much a flashcard in the traditional sense as was the case on the GBA and DS. And it's likely to have other restrictions. Doubtful it will breach the region lock. So a good number of dumped 3DS roms won't even run if your 3DS doesn't match up to that dump's region. And Nintendo will most likely be able to block the card in a software update. So the card will need to have an upgradeable firmware to prevent this. And Nintendo will probably be far more aggressive than they were in the past about blocking carts like this.

  4. @Granville:
If I recall correctly, DS flash carts started out this way as well. In time they will develop to support storing and loading multiple roms on a single cart and with that, homebrew app support. The latter will be awesome because it may enable emulators for more powerful systems that the DS couldn't handle (N64) or struggled with (GBA).
